Terms of Use

These Terms gove the use of the balitourus.com website (the "Platform"). By using the Platform and submitting a Request, you confirm that you have read and accept these Terms, have the legal capacity to do so, and act in your own interest. If you do not agree with the Terms, please do not use the Platform.

1. Definitions

  • Platform — the balitourus.com website and related communication cha

els, run by the project's independent team.

  • User — a person using the Platform to find and order excursions and related services.
  • Provider — an independent local guide or company that delivers the Service in its own name and under its own responsibility.
  • Service — an excursion, transfer, spa or other service listed on the Platform and delivered by a Provider.
  • Request — a User's enquiry to arrange a Service, submitted via the website or a messenger.
  • Service fee — the Platform's remuneration for selection, booking and support of a Request.
  • Prepayment — part of the Service price paid in advance and intended for the Provider.

2. The Platform's role

The Platform is an information intermediary (aggregator): it lists Providers' offers, helps you choose an option, place and manage a Request, and handles organizational communication between the User and the Provider.

The Platform does not provide excursions or other services itself. The contract for the Service is concluded directly between the User and the Provider; the Platform is not a party to that contract and is not responsible for its performance. The services are delivered by Providers — independent local guides and companies acting in their own name and under their own responsibility.

Individual offers may be subject to a Provider's special conditions (cancellation rules, participant requirements, restrictions, etc.). Such conditions supplement these Terms and prevail for the relevant offer.

The Platform may decline to accept or support a Request, and may suspend or terminate access to the Platform, in case of a breach of these Terms, misuse of the service, or a reasonable suspicion of fraud.

3. Provider obligations

The Provider is solely responsible for delivering the Service and warrants that:

  • the offer information (programme, route, duration, price, restrictions and participant requirements) is accurate and kept up to date;
  • it discloses in advance any material risks, physical requirements and restrictions (age, health, weather and other conditions);
  • it has the resources needed to deliver the Service and, where required, the necessary permits and qualifications;
  • it delivers the Service in line with the description and reasonable safety standards;
  • it keeps its contact details current.

The Platform selects Providers with reasonable care, but passes on their information "as is", does not verify or guarantee its completeness or accuracy, and is not responsible for it.

4. Booking process

  1. The User submits a Request via the website or a messenger.
  2. A Request by itself is not a concluded contract: a booking is considered made once the Platform or the Provider confirms availability and details (date, programme, price, number of participants).
  3. A Prepayment may be required to secure the booking.
  4. Changes (date, group composition, programme) are possible by agreement and subject to the Provider's availability.
  5. If the Service ca

ot be delivered (no availability, force majeure, weather or other constraints), the Platform or the Provider will offer a reschedule or a refund of the Prepayment.

The User is responsible for the accuracy of their contact details; with inaccurate or incomplete data the Platform ca

ot guarantee that the Request will be processed.

5. Payment

The price consists of the Platform's Service fee for selection, booking and support, the Prepayment for the Service intended for the Provider, and, where applicable, the remaining balance paid to the Provider on site. The amount, currency and payment method are agreed when placing the Request.

Payment is made via the methods agreed at booking. When paying in a foreign currency, exchange-rate fluctuations and payment-service fees may apply and are bo e by the User. The Platform does not store the User's payment details on the website.

Documents or confirmations for a Service actually delivered are provided by the Provider where needed. Taxes and mandatory charges related to receiving funds are paid by the respective recipient.

6. Cancellation and refunds

Cancellation and refund terms depend on the specific offer and Provider and are communicated to the User when the Request is confirmed.

The Platform's Service fee covers work already done on selection and support and is non-refundable. A refund of the Service Prepayment is handled according to the Provider's terms.

If the User fails to show up or arrives late without timely notice, the Prepayment may be non-refundable. If the Service is cancelled due to the Provider's fault or force majeure, the User is offered a reschedule or a refund of the Prepayment.

Refunds are made within a reasonable time, usually via the same method used for payment; bank and payment-service transfer fees are bo e by the User unless the Provider's terms state otherwise.

7. User obligations and responsibility

The User:

  • provides accurate information and arrives on time at the service's starting point;
  • assesses their own health and physical fitness and takes part in activities (volcano climbs, sea and water programmes, rafting, etc.) at their own risk, understanding that travel and active recreation carry inherent risks;
  • arranges and pays for their own travel and medical insurance covering active recreation; the Platform strongly recommends having such insurance but does not provide it and is not responsible for its absence;
  • is responsible for holding valid documents (passport, visas) and complying with local laws and rules;
  • follows safety requirements and the Provider's instructions, looks after personal belongings, and is responsible for any minors in their care.

8. Acceptable use

When using the Platform, the User undertakes not to:

  • provide false or misleading information or impersonate another person;
  • post unlawful, offensive, rights-infringing or misleading content;
  • use the Platform for unlawful purposes, to send spam, or to distribute malicious code;
  • carry out automated data collection (scraping), bulk copying, or actions that disrupt the Platform's operation;
  • infringe the intellectual property rights of the Platform or third parties.

The Platform may remove content that breaches these Terms and restrict access for violators without prior notice.

9. Limitation of liability

The Provider is responsible for the quality, safety, and actual delivery of the service. The Platform performs an intermediary (information and organizational) function only, is not the organizer of the excursions and activities, and does not control how they are carried out.

The Platform is not liable for harm to life, health, or property caused during the service, for the acts or omissions of the Provider, for decisions and risks taken by the User on their own, for the consequences of the User not having insurance, or for force majeure (weather, road conditions, natural events, acts of authorities, etc.).

To the extent permitted by applicable law, the Platform's total liability to the User on any grounds is limited to the amount of the service fee actually paid to the Platform for the relevant Request; the Platform is not liable for indirect losses, lost profit, or non-material damage.

The Platform makes reasonable efforts to keep offer information accurate but does not guarantee the absence of inaccuracies and may change the contents and terms of offers. Nothing in this section limits liability where such limitation is expressly prohibited by applicable law.

10. Intellectual property

The texts, photographs, design, logo and other materials of the website belong to the balitourus.com project or are used on lawful grounds. Copying, reproduction, automated collection (scraping) and any other use of the materials without written permission are not allowed.

By posting a review or other content, the User confirms that they hold the rights to it and grants the Platform a non-exclusive, royalty-free licence to use and publish it, including for marketing purposes, without territorial limitations.

The website may contain links to third-party resources; the Platform is not responsible for their content, availability or policies.

11. Electronic communications and notices

The parties recognize the legal force of electronic interactions. By submitting a Request or taking other actions on the Platform, the User accepts these Terms in electronic form.

Notices and messages sent to the email address provided by the User or to an agreed messenger are deemed proper written notice and received within a reasonable time after sending. The User undertakes to keep their contact details current.

12. Gove

ing law and disputes

The parties aim to resolve disputes through negotiation. A claim is sent to info@balitourus.com and is reviewed within a reasonable time.

The gove ing law and dispute-resolution procedure are determined by the place of registration of the Platform's operator; until registration is completed, the parties act on the basis of good faith and these Terms.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in force. The Platform's failure to enforce any of its rights does not constitute a waiver of that right.

13. Changes and contact

The Platform may update these Terms. The current version is posted on this page and takes effect upon publication; continued use of the Platform constitutes acceptance of the changes.
